Peculiarities of obtaining a permanent resident permit of a highly qualified professional

AHighly qualified professional is a foreign national who has work experience, skills or achievements in a particular domain if employment conditions offered to them in the Russian Federation provide for a salary (remuneration) in the amount set out in paragraph 1, Article 13.2 of the Federal Law “On the Legal Status of Foreign Nationals in the Russian Federation”. Aspects:

An HQP’s permanent residence permit is tied to the validity of the employment contract and work permit. Obtaining a permanent residence permit for an HQP does not exempt from the need to obtain a work permit for the HQP.

An HQP’s permanent residence permit can be extended for a new term, subject to the extension of the work permit of the HQP for a new term.

In the event that the employment contract is terminated and the foreign national being an HQP fails to enter into new contract as an HQPS within 30 business days from the termination date of dismissal, then his permanent residence permit and those of their family members will be cancelled.

Criteria for qualifying as a highly qualified professional:

  1. Remuneration / salary payable to them must be at least RUB 83,500 per calendar month for highly qualified professionals who are researchers or teachers if they are invited to carry out in research or teaching activities under bachelor programs, specialist programs, master programs, residency training programs, post-graduate internship programs accredited with government authorities or probation assistantship programs accredited with government authorities or programs designed for the training of scientific or scientific-pedagogical personnel within postgraduate training (higher military) programs administered by educational organizations of higher education, state science academies or their regional branches, national research centers or state research centers and for highly qualified professionals employed by residents of industrial, production, tourist and recreational or special economic port zones (except for individual entrepreneurs), organizations that carry out activities in the field of information technology that have received in the manner established by the Government of the Russian Federation, a document evidencing that it is an accredited organization carrying out activities in the field of information technology (except for organizations that have the status of a resident of a technical and innovative special economic zone);
  2. Remuneration / salary payable to them must be at least RUB 58,500 per calendar month for foreign nationals employed by residents of a technology development special economic zone (other than individual entrepreneurs);
  3. Remuneration / salary payable to them must be at least RUB 1,000,000 per annum (365 calendar days) in case of highly qualified professionals who are medical, pedagogical or scientific workers if they are invited to carry out related activities within the territory of an international medical cluster;
  4. Remuneration / salary payable to them must be at least RUB 83,500 per calendar month in case of foreign nationals employed by legal entities operating in the Republic of Crimea and federal city Sevastopol.
  5. without reference to salary requirements:
    • in case of foreign nationals participating in the implementation of the Skolkovo project in accordance with the Federal Law “On the Skolkovo Innovation Center” and foreign nationals participating in the implementation of the project aimed to create and operate an innovative center of science and technology in accordance with the Federal Law “On Innovative Centers of Science and Technology and Amending Certain Legislative Instruments of the Russian Federation”;
    • in case of foreign nationals employed by legal entities carrying out activities focusing on the priority development areas relating to Sirius federal territory on a submission from the public authorities of Sirius federal territory.
  6. emuneration / salary payable to them must be at least RUB 167,000 rubles per calendar month — in case of other foreign nationals..

List of documents for applying for an hqp prp:

as approved by Order No. 417 dated June 11, 2020 «On Approving the Administrative Regulations of the Ministry of Internal Affairs of the Russian Federation on the provision of public services for the issuance to foreign nationals and stateless persons permanent residence permits and replacement of permanent residence permits issued to foreign nationals and stateless persons in the Russian Federation»:

  1. Application for permanent residence permit (in 2 copies);
  2. 4 photographs of the foreign national (note: a 3.5 cm x 4.5 cm black and white photo, on matte paper with light background)
  3. Passport of the foreign national and its notarized translation;
  4. A copy and original of an employment contract or civil law contract providing for the performance of work (provision of services) considering the requirements set for a highly qualified professional.
  5. Migration card (if any) + its copy;
  6. Original and copy of the highly qualified professional’s work permit.
  7. A tear-off stub of notice of arrival at the place of stay (migration registration) + its copy;
  8. HIV-negative test certificate.
  9. Opinion issued by an addiction psychiatrist.
  10. Document confirming that the foreign national is not sick (leprosy (Hansen’s disease), tuberculosis, syphilis, chancroid, chlamydia lymphogranuloma).
  11. Police clearance certificate. Note: not required for individuals who arrived in the Russian Federation on a visa-free basis. The document must be apostilled or legalized by consular authorities unless otherwise provided by international treaties original of legalized document enclosing a notarized translation.
  12. Receipt evidencing the payment of state duty.

When applying for a permanent residence permit for family members of highly qualified professionals, the application must enclose documents confirming the relationship and any change in surname, name or patronymic.

In case of a change surname, name or patronymic, the application must enclose documents confirming such change. Documents issued by competent authorities of foreign jurisdictions must be legalized to be eligible for use in the Russian Federation.

Issuing a permanent residence permit to a highly qualified professional or members of their family is a state service that takes 3 months from the date on which the application is accepted.

Grounds for canceling the permanent residence permit issued to a highly qualified professional or members of their family

Pursuant to paragraph 4 of Article 9 of Federal Law 115, a permanent residence permit issued to a highly qualified professional may be canceled if the foreign national, in addition to other grounds:
